نقش مقاصد شریعت در پویایی اجتهاد و پاسخ‌گویی فقه شیعه به مسائل مستحدثه

مسئله نسبت میان «نصوص شرعی» و «تحولات مستمر زندگی بشر» از بنیادی‌ترین مسائل فقه اسلامی است. در فقه امامیه، اگرچه مقاصد شریعت به‌مثابه منبع مستقل در عرض کتاب، سنت، اجماع و عقل پذیرفته نشده است، اما مفاهیمی مانند ملاکات احکام، مصالح و مفاسد، فلسفه تشریع، حفظ نظام، نفی ضرر و رعایت کرامت انسانی، کارکردی نزدیک به مقاصد دارند و می‌توانند در فرآیند اجتهاد نقش راهنما ایفا کنند. این پژوهش با روش توصیفی-تحلیلی و مبتنی بر مطالعات کتابخانه‌ای، به بررسی این پرسش می‌پردازد که مقاصد شریعت چگونه می‌تواند موجب پویایی اجتهاد و پاسخ‌گویی فقه شیعه به مسائل مستحدثه شود. یافته‌ها نشان می‌دهد که بهره‌گیری از مقاصد، اگر در چارچوب نصوص معتبر و قواعد استنباط امامیه باشد، توان آن را دارد که فقه شیعه را از جمود بر ظواهر به سوی فهم عمیق‌تر از روح شریعت سوق دهد و در مواجهه با موضوعات نوپدید، زمینه صدور احکام متناسب و معتبر را فراهم سازد. در این میان، تجربه اجتهادی امام خمینی(ره) و تأکید ایشان بر زمان و مکان، نقش مهمی در تبیین ظرفیت‌های مقاصدی فقه امامیه دارد.

The issue of the relationship between "legal texts" and "continuous developments in human life" is one of the most fundamental issues in Islamic jurisprudence. In Imami jurisprudence, although the objectives of the Sharia are not accepted as an independent source in the context of the Book, Sunnah, consensus, and reason, concepts such as the criteria for rulings, interests and corruption, the philosophy of legislation, maintaining the system, negating harm, and respecting human dignity have a function close to the objectives and can play a guiding role in the process of ijtihad. This research, using a descriptive-analytical method and based on library studies, examines the question of how the objectives of the Sharia can lead to the dynamics of ijtihad and the responsiveness of Shiite jurisprudence to emerging issues. The findings show that the use of the objectives, if within the framework of authentic texts and Imami inference rules, has the potential to move Shiite jurisprudence from stagnation on appearances to a deeper understanding of the spirit of the Sharia and, when faced with emerging issues, pave the way for issuing appropriate and valid rulings. Meanwhile, Imam Khomeini's (RA) ijtihad experience and his emphasis on time and place play an important role in explaining the intended capacities of Imami jurisprudence.
